The terms for using GEEKED OUT, including GEEKED OUT Pro and the free trial.
Agreement
By downloading or using GEEKED OUT, you agree to these Terms and to Apple's Standard Licensed Application End User License Agreement (the "EULA"), which governs your license to use the app. If anything in these Terms conflicts with the EULA, the EULA controls. GEEKED OUT is designed and built by Joseph Rochlin (Jöí Fabü) ("we", "us").
What GEEKED OUT does
GEEKED OUT is a set of seven creative tools that work on your iPhone: Cut the weight, Write the line, Hit the grid, Flip the file, Scale the clip, Steal the shot and Master the mix. Results depend on the media you start with. Automatic features, including transcription, lyric syncing, beat and drop detection, smart framing, upscaling and mastering, can make mistakes. Please review what you make before you publish or distribute it.
GEEKED OUT Pro
- GEEKED OUT is used with a GEEKED OUT Pro plan: a Yearly subscription (with a 1-week free trial for eligible new customers), a Monthly subscription, or a one-time Lifetime purchase. Prices are shown in the app before you buy.
- With a free trial, you won't be charged until it ends. Cancel at least 24 hours before it ends and you won't be charged at all.
- Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Manage or cancel a subscription any time in iOS Settings → your name → Subscriptions. Cancelling stops future renewals; Pro continues until the end of the period you've paid for.
- If you buy Lifetime while a trial or subscription is active, cancel the subscription in Settings to avoid being charged for it.
- Refunds are handled by Apple under its policies, at reportaproblem.apple.com.
Your content
What you make is yours. We claim no ownership of the media you bring in or the work you create. You're responsible for having the rights to the music, footage, photos, artwork and lyrics you use, and for how you publish them, including delivery to Vevo, YouTube, Spotify, distributors or anywhere else. GEEKED OUT does not grant you any rights to other people's work.
Platform-ready exports
The Vevo master and Spotify Canvas exports are made to those platforms' published technical requirements as we understand them. Whether a video or Canvas is accepted is decided by those platforms and your distributor, and their requirements can change.
Deleting originals
When you choose to delete originals in Cut the weight, and confirm in iPhone's prompt, they move to Recently Deleted in Photos. iPhone keeps them there for 30 days, then removes them permanently. Please check your new copies before deleting.
Acceptable use
Use GEEKED OUT only for lawful purposes and in line with these Terms and the EULA. Don't attempt to copy, reverse engineer, resell or interfere with the app, except as the law allows.
Third-party services
GEEKED OUT uses features provided by Apple, including Photos, on-device speech recognition, translation and the App Store. We're not responsible for third-party services, which have their own terms.
Disclaimer
GEEKED OUT is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special or consequential damages, or any loss of data or profits, arising from your use of GEEKED OUT. Our total liability for any claim is limited to the amount you paid for GEEKED OUT in the 12 months before the claim.
Changes
We may update these Terms. We'll post the new version here with a new effective date; continuing to use GEEKED OUT after that means you accept the changes.
Governing law
These Terms are governed by the laws of the State of California, USA, except where the law of your country of residence requires otherwise.
